Terms of Service
Last updated: 18 June 2025
1. Acceptance of terms
By accessing or using BillCheck SA ("the Service"), you agree to be bound by these terms. The Service is operated by the Kgusiame Group. If you do not agree to these terms, do not use the Service.
2. Nature of the service
BillCheck SA provides an automated bill analysis tool that compares user-submitted billing data against publicly available tariff schedules and identifies potential anomalies. The Service generates informational reports and template dispute letters.
The Service does not constitute legal advice. Results are based on rule-based analysis of the data you provide and publicly available tariff data, which may not reflect the most current approved rates. Always verify with your municipality or service provider before taking action.
3. User obligations
- You must provide accurate and truthful billing information.
- You must not use the Service to generate fraudulent dispute letters.
- You must not attempt to circumvent payment controls.
- You may only use the Service for your own personal household bills.
4. Payments and refunds
Per-statement payments (R49) are processed by Paystack and are non-refundable once the dispute letter PDF has been generated and made available for download or email delivery.
Monthly subscriptions (R59/month) may be cancelled at any time. Cancellation takes effect at the end of the current billing cycle. No partial-month refunds are issued.
5. Intellectual property
The dispute letter generated by the Service, once unlocked and downloaded, may be used freely by you for the purpose of submitting a dispute to the relevant authority. All other content, code, and materials on the Service remain the intellectual property of the Kgusiame Group.
6. Limitation of liability
The Kgusiame Group shall not be liable for any outcome of a dispute submitted using a BillCheck SA dispute letter, including but not limited to: failed disputes, service disconnection, or debt collection action. The Service is provided on an "as is" basis. We make no warranty that tariff data is current or accurate.
To the extent permitted by South African law, our total liability to you in respect of any claim arising from use of the Service shall not exceed the amount you paid for the specific transaction giving rise to the claim.
7. Governing law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
8. Changes to these terms
We reserve the right to update these terms. Continued use of the Service after changes are posted constitutes acceptance of the updated terms. Material changes will be communicated to registered users by email.
